These Terms & Conditions govern the services provided by Croydon PAT Testing (“we”, “us”, “our”).
By contacting us, submitting an enquiry, or using our services, you (“the Client”) agree to these Terms.
1. Nature of Our Services (Dual Role – Important)
Croydon PAT Testing operates in two distinct capacities depending on the service arrangement:
1.1 PAT Testing Services (Direct Work by Us)
Where Croydon PAT Testing carries out Portable Appliance Testing (PAT Testing) directly:
- We act as the service provider
- A legally binding contract is formed between you and Croydon PAT Testing
- We are responsible and liable only for the PAT Testing work we personally carry out
1.2 Referred Services (Including Outsourced PAT Testing)
In some cases, including where we are unavailable or where additional services are required, we may refer you to an independent third-party contractor (“Partner Contractor”).
This may include:
- PAT Testing (where carried out by a partner)
- Electrical inspections (EICR)
- Gas Safety certificates
- Fire risk assessments
- Legionella risk assessments
- Other compliance services
In all such cases:
- Croydon PAT Testing acts strictly as an introducer only
- We do not carry out the work
- We do not supervise, manage, or control the services
- We do not enter into any contract for those services
A separate legally binding contract is formed directly between you and the Partner Contractor.
2. Formation of Contract
- Where we carry out PAT Testing: the contract is with Croydon PAT Testing
- Where a Partner Contractor carries out any service (including PAT Testing): the contract is with the Partner Contractor only
Croydon PAT Testing is not a party to any agreement between you and a Partner Contractor.
3. Independent Contractor Status
All Partner Contractors:
- Operate as independent businesses
- Are not employees, agents, or representatives of Croydon PAT Testing
- Are fully responsible for their own work, conduct, and compliance
4. Limitation of Liability
4.1 Work Carried Out by Croydon PAT Testing
We are only responsible for PAT Testing services we directly perform.
To the fullest extent permitted by law, our liability shall be limited to:
- The total value of the PAT Testing service provided, or
- The level of our applicable insurance cover
We shall not be liable for:
- Indirect or consequential losses
- Loss of profit, revenue, or business interruption
4.2 Work Carried Out by Partner Contractors
To the fullest extent permitted by law, Croydon PAT Testing shall not be liable for:
- Any work carried out by Partner Contractors (including PAT Testing where outsourced)
- Any loss, damage, or defects arising from their services
- Any negligence, acts, or omissions
- Any failure to meet legal or regulatory requirements
- Any certificates, reports, or documentation issued
5. Legal Recourse
You agree that:
- Any claim, dispute, or legal action relating to services carried out by a Partner Contractor must be brought solely against that contractor
- Croydon PAT Testing shall not be held liable for such services
If we are nevertheless included in any claim relating to third-party services:
- You agree to indemnify us in full for all associated costs and expenses
6. Indemnity
You agree to indemnify and hold harmless Croydon PAT Testing against:
- Any claims arising from services performed by Partner Contractors
- Any disputes between you and a Partner Contractor
7. No Warranties (Third-Party Services Only)
We make no guarantees regarding:
- The competence or suitability of Partner Contractors
- The quality or outcome of their work
Any checks we carry out are limited and do not create liability.
8. Client Responsibility
You are responsible for verifying:
- Contractor identity
- Qualifications and certifications
- Valid insurance cover
before allowing any work to proceed.
9. Fees & Payments
- Where we carry out PAT Testing: payment is made to Croydon PAT Testing
- Where a Partner Contractor carries out any service: payment is made directly to the Partner Contractor
We do not handle payments on behalf of Partner Contractors.
10. Statutory Rights
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including under the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977, including:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Your statutory rights
11. Governing Law
These Terms are governed by the laws of England and Wales.
12. Acceptance
By using our services, you confirm that:
- You understand whether Croydon PAT Testing is acting as a service provider or an introducer
- You accept that we are only responsible for PAT Testing we directly carry out
- You accept that all other services (including outsourced PAT Testing) are the responsibility of the Partner Contractor
- You agree to these Terms in full
